This Privacy Policy applies to, and only to, personal data collected through academymuseum.org (the “Site”) and the Academy Museum app (the "App").
The Academy Museum Foundation (“we” or “us”) is the operator of the Site and controller of that data. A link to this Privacy Policy is set out in the footer information carried on every page of the Site. Maintaining the privacy of user personal data is important to us, and informing our users of the types of information we collect, and how we treat it, is critical to our operation.
WHAT TYPES OF PERSONAL DATA DO WE COLLECT FROM YOU THROUGH THE SITE?
Under this Privacy Policy, your “personal data” is any information that identifies you or makes you identifiable. The types of personal data we may collect and process about you include some or all of the following:
Identity information - first name, last name, username and password for website ticketing, member, and press portals.
Contact information - physical address, email address, and telephone number.
Financial data - payment card details and donation or payment information.
Transactional data - details about the events you have attended or participated in, inquiries you have made, orders you have placed, and payments or donations received from you.
Subscription, marketing, and communications information - details regarding newsletters you have subscribed to, requests for information received from you, and information on your marketing or communication preferences.
We may collect this information when you join the Academy Museum of Motion Pictures (“Academy Museum”) as a member, purchase a ticket, make a donation, sign up to receive emails or other publications, become a volunteer, participate in a poll or survey, make a purchase through our affiliated webstore, communicate with us, create a user or member profile on our Site, or otherwise directly provide the information to us.
Like most major websites, we use the following technologies to automatically collect certain additional information about you.
Log Files. We collect your Internet Protocol (“IP”) address, which identifies the computer or service provider you use or, if you connect through a mobile device, your mobile device identifier, locational information, date and time of access, clickstream data, browser type, referring/exit pages, and operating system. We use these to administer the Site, track user movement around the Site, analyze trends, and gather user demographic information.
Cookies. Cookies are small text files that can be used by websites to make a user’s experience more efficient, and for determining a user’s preferences. The Site uses different types of cookies to, among other things, automatically recognize you when you return to the Site, store information regarding your preferences, personalize content and advertisements for you, provide social media functionality, and analyze Site traffic. Website visitors can also change or withdraw their consent to certain types of cookies by visiting that page. If cookies are disabled, you may not be able to enjoy certain features of the Site, such as being recognized when you log in, not having to enter your username, using a shopping cart, or moving on to checkout. Some of our partners use cookies on our site, but we have no control over those cookies and this Privacy Policy does not apply to them. We do not honor “Do Not Track” signals. You can at any time change or withdraw your consent from the Cookie Declaration on the Site.
Pixels and other technologies. The Site may use other tracking tools, including web beacons, tracking bugs, tracking pixels, and clear gifs, which are small electronic images embedded in web content and email messages that are not ordinarily visible to users. These techniques allow us to track pages and content accessed and viewed by users, as well as to monitor email readership, to analyze traffic on the Site, improve content and navigation, enhance marketing, and personalize your experience. In the future we may use web beacons to provide online display ads and offline ads tailored to your interests, and to share your personal data with non-profit organizations or art institutions we believe to be reputable. We also contract with service providers to place Academy Museum advertisements on Facebook and other social media applications. You may be able to opt out of pixels by adjusting your browser’s cookie settings.
Profiles. We combine information that we obtain through cookies, tracking tools, and other sources to create a profile of your preferences. We use this information to provide personalized offers and to show you content most likely to be of interest to you.
The information collected through these technologies may be combined with your personal data or aggregated with other information on website visits of others. We may share information about your use of the Site with our social media, advertising, and analytics partners, who may combine it with other information that they have or will acquire.
WHAT TYPES OF PERMISSIONS DO WE COLLECT FROM YOU THROUGH THE APP?
Under this Privacy Policy, the Academy Museum may collect information about you in a variety of ways. The information we may collect via the App depends on the content and materials you use, and includes:
Geo-Location Information. We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the App, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.
Mobile Device Access . We may request access or permission to certain features from your mobile device, including your mobile device’s Location, Camera, and Motion and Activity features. If you wish to change our access or permissions, you may do so in your device’s settings. Your Location is used to alert you when you are near interactive moments and to unlock landmarks in the Hollywood Past & Present feature. Your Camera is needed to view augmented reality (AR) features. Access to your Motion and Activity is needed to improve the battery performance of your device when receiving background alerts near Hollywood Past & Present landmarks.
Mobile Device Data. Device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide helps the Academy Museum monitor the App's stability with crash reports and error logs.
Push Notifications. We may request to send you push notifications regarding from the App. Notifications may include alerts, sounds, and icon badges. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.
Third-Party Data . Information from third parties, including marketing ad performance information, such as impressions, clicks, placement, and viewability of the App.
HOW DO WE USE YOUR PERSONAL DATA?
We use your personal data to do a better job of informing you about the Academy Museum, handling your contributions, processing your transactions, and analyzing statistics. When you join or donate, we ask you to provide personal data that is necessary to process your tickets, membership, or donation, which includes the types of information described above. Your credit card information will be temporarily stored on a server intended to be secure, and will be used solely to process your transaction. We will then retain your information to facilitate servicing you in the future. Your information may also be used to optimize your experience on our Site and ensure that our content is presented to you in the most effective manner, including administering user profiles and accounts in our online user portals, notifying you about changes to the Site or any services we offer, communicating with you by email, postal mail, or telephone about our mission, activities, opportunities, and other issues that may be of relevance to you, and performing other functions described to you at the time of collection or that you otherwise consent to.
There is no legal obligation that you provide us with any personal data, but if you decline to provide any personal data we request, it may result in your being unable to use certain features of the Site, such as requesting information about or purchasing products or services, asking questions, and initiating other transactions on the Site.
IN WHAT CIRCUMSTANCES, AND TO WHOM, DO WE DISCLOSE YOUR PERSONAL DATA?
We may share personal data that we collect from or about you as follows:
With our parent organization, the Academy of Motion Picture Arts and Sciences, and other companies that our parent owns, for use in marketing their products and services.
With trusted service providers, contractors, and suppliers to the extent they need it to support our activities under a contractual relationship to assist our programs and operations. For example, we frequently use a vendor to mail information to members in the United States and, in the course of doing so, may share personal data with the vendor as necessary to complete the mailing. Likewise, from time to time, we utilize a vendor to run contests or sweepstakes and share certain personal data regarding the participants with the vendor;
With our payment card processor to the extent required to process membership donations, ticket purchases, or other payments;
With our marketing providers to the extent required to assist us with online advertising and the creation of advertising content. You may opt out of disclosures to any, some, or all of these marketing providers by using the e-mail, toll-free phone, or mail address set forth below in our Contact Information. Please allow five (5) days from receipt of your communication until your opt-out is in force;
With a buyer or other successor prior to or in the event of a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as a part of bankruptcy, liquidation, or similar proceeding, where the information is among the assets being transferred, in which case we will seek to impose on our successor (except that in a bankruptcy or similar proceeding, we cannot guarantee imposition of) any restrictions to which the personal data is subject; and
For any other purpose disclosed by us when you provide the information or to which you subsequently agree.
Our agreements with the third parties described contain terms, as appropriate, requiring them to treat your personal data in accordance with this Privacy Policy.
We may disclose your information as necessary to comply with a subpoena or similar investigative demand, court order, or request for cooperation from law enforcement or other governmental agency, to exercise our legal rights, or as otherwise required by law.
When the personal data we collect is aggregated, anonymized, or otherwise does not identify you or render you identifiable, we may share it with any party to the extent permitted by law.
WHAT ARE YOUR CHOICES ABOUT THE COLLECTION AND USE OF YOUR INFORMATION?
We strive to provide you with choices regarding the personal data you provide to us. You can opt out of receiving solicitations for subscriptions from us and correct your identity and contact information through our member, ticket, and press portals. You can opt out of receiving informational or promotional emails from us by clicking the “email preferences” link in any such email you receive from us.
You can contact us if you would like to obtain a portable copy of your personal data that we maintain, rectify errors in or, in certain circumstances, erase any of that data, and restrict or object to our processing of any of it. You can do so by emailing us at academymuseumdata@oscars.org or by using the Contact Information below, and describing the personal data in question . This is a free service, unless your request proves to be unduly difficult, or is clearly unfounded, repetitive, or excessive, in which case we may charge a reasonable fee or decline to comply. Once we have received your request, we will contact you within 30 days of our receipt , unless your request is complex or you have made a large number of requests, in which case we will notify you of any delay and will, in any event, reply within three (3) months .
WHAT TYPE OF PROTECTION DO WE OFFER FOR YOUR INFORMATION?
We take appropriate administrative, technical, and physical measures to protect your personal data from loss, theft, and unauthorized use, disclosure, or modification. For example, we limit access to personal data to ensure that it is accessible only by relevant staff, volunteers, or contractors. Our online forms are encrypted, and our network is protected and routinely monitored. If you use a payment card, we pass your payment card information using a significant level of security to our payment processing partners. We do not store your payment card information for future use. When confirming an order, we disclose only the last four digits of your credit card number, although we transmit the entire credit card number to the credit card company when the order is processed.
No data transmission over the Internet is 100% secure. While we strive to protect your personal data, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk. We use various tools (usernames, passwords, encryption, physical security, etc.) to protect it against unauthorized access, use, and disclosure. Nevertheless, unauthorized interception of transmissions of your personal data, or unauthorized access to it in storage, is possible. Therefore, although we strive to protect your privacy, we cannot promise that your personal data will invariably remain private.
Further, users and members are responsible for safeguarding the confidentiality of their account information, including the username and password to access the user portals and individual user profiles. Please do not share such account information or passwords with anyone and remember to log out when you are not using the Site to prevent unauthorized access.
WHAT RIGHTS ARE PROVIDED UNDER THE GDPR?
The European Union’s General Data Protection Regulation (“GDPR”) is a privacy law that affords certain rights relating to the personal data of individuals in the European Economic Area (“E.E.A.”). Specifically, if you are in the E.E.A., you have a right to learn from us whether we are processing your personal data, our purposes in doing so, how your personal data was obtained (if you did not provide it to us directly), who it may have been shared with, and how long it will be retained. Further, you have the right to request your personal data be corrected if it is inaccurate and, in certain circumstances, may ask that it be erased, you may withdraw your consent to any processing whose legal basis is consent, and you may object to further processing. Finally, subject to certain limitations, and when feasible, you may request a copy of your personal data or that it be transferred in portable electronic form to another entity. You will not typically need to pay a fee to exercise any of these rights. But we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

For the personal data that we collect from you, we act as a “controller” under the GDPR. As discussed above, we use data for a variety of different purposes. Under the GDPR we are required to have a lawful basis for all processing. Most of the time, that lawful basis will either be to (1) perform a contractual obligation we have with you, (2) fulfill our legitimate interests, (3) comply with a legal obligation, or (4) conduct processing to which you have specifically consented. Our legitimate interests include maintaining this website to assist us in our activities regarding the Academy Museum.
For example, we need to process your personal data in order to register you as a member and provide you with the benefits of membership. In that circumstance, our lawful basis for processing your personal data will be to perform contractual obligations for you when you signed up to be a member. Likewise, it may be necessary to our legitimate interests of growing and continuing our services for us to use your personal data in order to provide you with information regarding our activities and to solicit future donations.
Your personal data may be transferred to our servers in the United States. Because the United States has not received an “adequacy” finding from the European Commission, we transfer your personal data only with your explicit consent (which you may withdraw at any time), or to perform our agreement with you.
HOW LONG DO WE RETAIN YOUR PERSONA: DATA?
We keep your personal data for as long as we have an ongoing relationship with you, and as required by any legal obligation to which we are subject.
DOES THE SITE EMPLOY ANY THIRD PARTIES TO COLLECT YOUR PERSONAL DATA ACROSS TIME AND SPACE?
We engage third-party vendors to help us operate the Site and App, process your transactions, respond to your needs, and enhance our marketing. In managing these matters, the Site and App works with third-party analytics and marketing partners who use cookies and web beacons on our behalf. We believe each of these partners to be reputable and capable. These partners include third-party analytics vendors such as Google Analytics, and others, who serve advertisements tailored to your interests on our behalf. They may use information about your visits to the Site and other sites to personalize ads. We and these partners use this analytics data for several purposes, such as to improve the design and content of the Site, to inform us about such matters as which pages are most attractive to visitors, what promotions are most attractive to users, and how successful our advertising is. As indicated above, we employ a partner to determine the site you visited immediately before and immediately after visiting the Site. We use that visitation data only in the aggregate to understand where our traffic is coming from and where it goes.

The effective date of the current Privacy Policy is posted at its beginning. We may modify this Privacy Policy at any time, from time to time, without notice. Modifications may be occasioned by changes in the services offered through the Site, changes in the law, changes in our internal decision-making process, or by other factors. You may wish to visit the policy from time to time to review the most recent version. Each such modification will be effective upon posting the revised Privacy Policy on the Site. Your continued use of the Site after that new effective date will constitute your agreement to the terms of the new Privacy Policy with regard to all personal data that you have submitted or will submit to the Site.
DOES THIS PRIVACY POLICY COVER WEBSITES LINKED TO THE SITE?
You may find on the Site links to other websites. We believe these transferee websites are operated by reputable organizations, but we have no control over them and cannot be held responsible for their conduct. Accordingly, this Privacy Policy does not apply to these linked websites. In using such websites, you should read their privacy policies and terms of use.
